TERMS AND CONDITIONS OF USE

Access to or use of the website hosted under the domain name pacodelucialegacy.com owned by The Foundation (the “Website”) implies acceptance by the user of these Terms of Use.

NON-PERMITTED USES

As a user of the Web Site, we inform you that it is PROHIBITED and, therefore, its consequences will be of your exclusive responsibility, the access or use of the Web Site for illegal or unauthorized purposes, with or without economic purpose, and, specifically, and without the following list being absolute, it is prohibited:

Use the Web Site illegally, or in any other way that could damage, overload or harm the Web Site itself.

EXEMPTION FROM LIABILITY

The Foundation is not responsible for any of the contents, files, information, advertising, opinions, concepts and images that are issued, published or distributed directly or indirectly through any interconnected website accessed through the Website by means of links, or any of the services that are linked or related to this interconnected site.

The Foundation provides its services and contents on a continuous basis, using all the technical means at its disposal to provide them in a satisfactory manner.

All trademarks and logos of The Foundation referred to on the Website are trademarks or registered trademarks of The Foundation.

The user who shares an initiative through the “Create initiative” tab of the Website consents to the exclusive transfer to the Foundation of all intellectual property rights, industrial, image and/or rights of analogous or similar nature on the initiative. Specifically, the Foundation will have exclusive ownership, without time or territorial limits, and free of charge, of all exploitation rights and, in particular, of the rights of reproduction, distribution, public communication, fixation, making available to the public, and any form of transformation, modification, alteration, translation, adaptation, arrangement or any other transformation of the initiative. In any case, the user guarantees that his initiative does not infringe the intellectual, industrial and/or image rights of third parties. Failing that, users will be liable for any damage and / or harm that may be caused to the Foundation.

Likewise, the user consents to the transfer to The Foundation of the image rights over the contents (photographs and/or videos) that the user attaches to his/her initiative; corresponding to The Foundation its ownership without time limit, non-exclusive, free, and for the whole world, and authorizing The Foundation to use them for the purpose of carrying out any commercial, promotional and/or advertising activities of the initiative. In any case, the user has the right, at any time, to revoke the assignment of image rights, by contacting the Foundation through the following e-mail address info@fundacionpacodelucia.com.

CHANGES AND MODIFICATIONS OF CONDITIONS

The Foundation may, at any time, modify these Terms of Use, by communicating it through the Website.

The Foundation shall be exempt from any liability arising from the actions described in this clause, when publishing the modifications on the Website.

APPLICABLE LAW AND JURISDICTION

The current regulations will determine the laws that should govern and the jurisdiction that should know the relationship between the Foundation and the user and the Website. Notwithstanding the foregoing, in those cases in which current legislation provides for the possibility for the parties to submit to a specific jurisdiction, the Foundation and the user, expressly waiving any other jurisdiction that may correspond to them, submit to the Courts and Tribunals of the city of Madrid.
